It is stated that these conditions exclusively govern the sale by Mas Comtal of products presented on its website, and that the products offered are reserved for individuals.

The confirmation of an order for a product offered on the website https://www.mascomtal.com implies your express acceptance of these general conditions of sale, without your signature being necessary to confirm acceptance.

Preliminary Clause

This merchant undertakes not to allow any transaction that is illegal, or deemed by credit card brands or the acquiring bank to have the potential to damage their goodwill or negatively influence them. The following activities are prohibited under card brand programs: the sale or offer of a product or service that is not in full compliance with all applicable laws to the buyer, issuing bank, Merchant, Cardholder, or cards.

The sale of alcoholic beverages to minors under 18 years of age is explicitly prohibited.

Clause 1.

1.1. How to find products on https://www.mascomtal.com

You can consult or search for the products you wish to purchase using the search bar at the top right, where you can enter the name of the product you are looking for, or by Browse any of the sections you find on the website. Once you find the desired product, you should click on its name or title to view the information page and find details about the product.

If you are unsure about the item you are looking for, you can select the product category you want in the top menu of the main page. Different sections will open allowing for more precise searches.

The advanced search allows you to choose by multiple search criteria. If you cannot find the product you are looking for, please send an email to mascomtal@mascomtal.com.

1.2. How to add products to the shopping cart.

If you have decided to purchase a product on https://www.mascomtal.com, click the “Add to cart” button located on each product page. You can continue Browse until your cart contains all the products you wish. You can view your cart at any time by clicking the “My Cart” button in the top right corner of the page, indicated by a “shopping cart” icon.

1.3. Password.

If you have forgotten your password, click on “Forgot your password?”, enter your email address and you will quickly receive an email with a new password. If you do not receive the email in your inbox, please check your spam or junk mail folder. You can change the new password in “User Area”, at the bottom of the screen.

Clause 2. Order Modalities.

Contractual data will be subject to confirmation and this contractual data will be collected before shipment is made.

Mas Comtal reserves the right to cancel or reject any order from a client with whom it has a dispute regarding the payment of a previous order.

Mas Comtal undertakes to accept order requests in accordance with the terms of the general conditions of sale set forth herein.

The client declares to know and accept these general conditions of sale before confirming their orders.

The confirmation of an order therefore implies the acceptance of these general conditions of sale. Unless proven otherwise, the data registered by Mas Comtal constitute proof of the set of transactions carried out between Mas Comtal and its clients.

Mas Comtal will do everything possible to manage all orders.

Clause 3. Availability.

Product and price offers are valid as long as they are displayed on the website, and always subject to available stock.

In the event that the product is not available after an order has been processed, the client will be informed by email or telephone of the delivery of only part of their order, or its cancellation. The client will receive a refund of the full or partial amount of their order within a maximum of 30 (thirty) days from the date the order was placed.

Clause 4. Shipments and order tracking.

4.1. General aspects.

The delivery time once the order is confirmed will be a maximum of 7 (seven) working days. However, this period may vary depending on the distribution network provided by our carriers for each region.

Deliveries are not made on Saturdays, Sundays, or public holidays.

4.2. Order collection.

When placing your order, you can specify the delivery address where you want us to send your order.

Mas Comtal reserves the possibility of splitting shipments. Orders are sent through various logistics operators. In this case, only the management and shipping costs corresponding to a single shipment will be billed.

Mas Comtal assumes no responsibility for the consequences of possible delays in shipping.

4.3. Order tracking.

Once the order has been placed, you can track its status in your account. Your order will be:

Received: When payment is verified and the order is passed for package preparation.
Processing: When the order leaves the warehouse, it is picked up by the transport agency for shipment to the recipient.
Completed: When we verify that the order has been delivered to the recipient and then send the invoice by email, if requested.
In all 3 (three) cases, when the order status changes, you will receive an email with updated information on your order’s status.

You will be informed at all times by email of the order’s situation.

4.4. Problems with delivery.

If the client is not at the indicated address to receive their package, an attempt will usually be made to deliver the package to a family member or a person living at the same address. If this delivery fails, a notice will be left for the recipient with all shipping details and the transport company’s contact number to arrange a new delivery date.

If the recipient does not contact the transport company within 2 (two) days following the first attempt, the agency will contact the recipient to arrange a new delivery.

Upon receiving their package, the client must:

Verify the conformity of the goods received at the time of delivery.
Note any anomaly on the delivery note, stating their reservations and including their signature.
If necessary, to resend the items to Mas Comtal, the transport company will contact the client to arrange a pick-up day and time. The merchandise must be accompanied by the original delivery note.
In the event that the product is delayed or does not reach its destination, the client can contact Mas Comtal’s customer service by sending an email via the contact form at mascomtal@mascomtal.com.

In the event of a return due to the impossibility of delivering the order (incorrect recipient address, expired collection period, etc.), the client will be automatically notified by email. If Mas Comtal does not hear from the client within 1 (one) month from the receipt of the email, it reserves the right to cancel the order.

Clause 5. Returns.

5.1. General Return Conditions.

In accordance with the provisions of Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users, the client has a return period of 14 (fourteen) calendar days from the receipt of the merchandise.

The right of return cannot be exercised if there are indications that the products have been opened, manipulated, or exposed to unsuitable conditions. It is mandatory to return the products properly protected, in their original packaging, in perfect condition for their subsequent resale.

No package will be accepted that does not include any of the sender’s identification elements (name, surname, address, order number). The return of the requested products or services will result in a refund of the total amounts paid by the client.

These amounts must be credited to the client’s bank account within 14 (fourteen) calendar days from the exercise of the right of return. Refunds will be made via bank transfer.

In all cases, an email will be sent to the client informing them of the refund.

Return shipping costs are borne by the client.

Returns resulting from an error by Mas Comtal or a product defect are excluded from this condition. In such cases, Mas Comtal undertakes to exchange the defective product for an identical one or to refund the amount, assuming the return and subsequent shipping costs, if applicable.

Mas Comtal will not accept any exchange or return unless prior notification has been received.

Cash on delivery shipments will not be accepted.

In accordance with banking legislation, refunds cannot be made to credit cards whose expiration date has passed. In such cases, Mas Comtal reserves the right to request all necessary data from the client to effect the corresponding refund.

5.2 How to cancel your order.

If you have already made a purchase and wish to cancel your order, and you have not yet received it, please contact mascomtal@mascomtal.com or call. 93 897 00 52. If the order has not been dispatched, it will be cancelled, and the purchase amount will be fully refunded by the same method used for payment. If the package has already been dispatched, you will need to wait for its receipt before proceeding with its return.

5.3. When can I cancel my order.

The order can only be modified before it is dispatched. For this reason, please contact us as soon as possible via email at mascomtal@mascomtal.com or by phone at 93 897 00 52. If the order has not been dispatched, it will be cancelled, and the full purchase amount will be refunded via the original payment method. If the package has already been dispatched, you will need to wait for its receipt to proceed with its return if you deem it appropriate.

5.4. Order delivered with a broken bottle.

The shipping packaging is designed to prevent breakages, and our partners are highly aware of the product’s fragility, but some breakage may still occur.

Upon receiving your package, please do the following:

Verify the conformity of the merchandise received at the time of delivery.
Note any anomaly on the delivery note, stating your reservations or comments along with your signature.
Transport providers do not allow the return of merchandise if the client opens it in their presence, but you can inspect the box from the outside. If you notice that the box is damp or wet, do not accept the order. The transport agency will notify us of the incident, and we will automatically send a new shipment at no additional cost.

5.5. Bottles not in good condition.

At https://www.mascomtal.com, we regularly taste the batches we serve and maintain a high product rotation, which allows us to detect any anomalies. Nevertheless, it is possible that a bottle may not arrive at its destination in good condition. In such a case, we will replace it at no cost.

5.6. Incomplete order or not corresponding to what was ordered.

In the event that the bottles received do not match your order, simply send an email to mascomtal@mascomtal.com or contact us at 93 897 00 52 indicating your details and order information, and we will replace the order at no cost.

Upon receiving your package:

Verify the conformity of the merchandise received at the time of delivery.
Note any anomaly on the delivery note, stating your reservations and including your signature.

Clause 6. Products.

The products offered comply with current Spanish legislation and the applicable regulations in Spain.

Mas Comtal will do its utmost to ensure that the photographic images of its products faithfully represent the products offered. Likewise, each product is accompanied by an accurate description of its main characteristics. In the event of a clear discrepancy between the characteristics of the product and its representation, the client may return it and request a refund as stipulated in Clause 5.

Clause 7. Price.

7.1. The prices of the products are expressed in euros with all taxes included; management and shipping costs are not included, and their amount will be indicated at the time of the final confirmation of each order, based on the quantity ordered and the delivery address.

7.2. Mas Comtal reserves the right to modify its prices at any time, but products will be invoiced based on the rates in force at the time the order is registered.

7.3. The risks of the products will be borne by the client from the moment of their delivery.

Ownership of the product will be transferred to the client at the time of delivery, provided that payment has been made in advance. Otherwise, the transfer of ownership will be conditioned upon payment of the price.

Clause 8. Payment.

8.1. Payment method.

Purchases can be paid by payment card, PayPal, or bank transfer.

The following credit cards are accepted: Visa, Visa Electron, and Mastercard.

The charge will be made to the client’s account within a maximum of 4 (four) days from the order date, which will be considered effective after confirmation of the agreement between the payment centers.

All purchase transactions are conducted within a strict framework of confidentiality and encryption thanks to the SSL protocol.

When the client clicks the “Complete purchase” button during order confirmation, the validity of the credit card number will be verified, and it will be checked that it is not blocked. This action will be carried out on the payment gateway of the “BBVA” banking entity.

Mas Comtal will under no circumstances have access to your bank details or store them on its servers. For this reason, the client must provide them again each time they make a new transaction on our website.

In this way, the client obtains double protection against abuse and fraud.

8.2. Secure Payment

In accordance with our commitment to payment security, we inform you that “BBVA” is responsible for verifying the reliability of the data provided during an order with card payment.

Mas Comtal reserves the right to request from its clients a copy (by fax or postal mail) of both sides of their national identity document, as well as proof of address less than 3 (three) months old. No order can be sent before the receipt and verification of these documents. The requested documents must be sent within 6 (six) business days.
Mas Comtal reserves the right to refund the order if the aforementioned documents are not received, or if they are not valid.

Clause 9. Modifications.

The information appearing on this website is current as of its last update. Mas Comtal reserves the right to update, modify, or delete the information on this website.

This website cannot be altered, changed, modified, or adapted. However, Mas Comtal reserves the right to make, at any time, the changes and modifications it deems appropriate, and may exercise this right at any time and without prior notice regarding the availability of its products and campaigns.

Mas Comtal reserves the right to unilaterally modify the general conditions of sale, as well as the conditions and terms of use of this website. Any modification thereof will be duly announced. The entry into force of the modifications to the conditions of use will occur from the moment of their publication on this website.
